Abstract
The Social Media platform WhatsApp has filed a writ petition to quash new IT Rules (2021) which makes it mandatory for social intermediaries to trace the originator of alleged fake news and other blatant misuses. This is, primafacie, an affront against right to privacy, guaranteed as fundamental right to life in the Puttaswamy Case (2017). The Government on the other hand believes that this is a legitimate exercise of reasonable restriction under Article 19(2) of the Constitution.
