Abstract
Bu çalışmanın amacı İslam hukukuna göre zihinsel yetersizliği olan bireylerin yasal hakları, bu hakların kullanımı, yasal haklarından kaynaklanan toplumsal statülerinin incelenmesidir. Bu amaçla İslam hukukunda farklı mezheplere göre yapılmış fıkıh tartışmalarına yer verilmiştir. Ayrıca İslam dinine göre zihinsel yetersizliğin nasıl tanımlandığı ve zihinsel yetersizliği olan bireylerin kişisel haklarını nasıl kullanacakları tartışılmıştır. Ortaçağ İslam toplumlarında zihinsel yetersizliği olan bireylerin toplumsal statüleri cezai sorumluluk, evlilik ve boşanma, kölelik, toplumsal ve dinsel yaşam, eğitim, kurumsal bakım başlıkları altında ele alınmaya çalışılmıştır.
